At DAMO GmbH, we take the protection of your personal data very seriously. This Privacy Policy informs you about what data we collect, for what purposes we process it, and what rights you have as a data subject, in accordance with the Swiss Federal Act on Data Protection (revFADP) and applicable regulations.

Through the forms on our website and in connection with the provision of our transport services, we collect the following categories of personal data:

2.1 Data provided directly by the user

  • First and last name

  • Email address

  • Phone number

  • Company name (where applicable)

  • Message or description of the service requested

  • Payment data (processed securely by Stripe or PayPal — DAMO GmbH does not store card data)

2.2 Automatically collected data

  • IP address and browsing data (pages visited, session duration, device and browser type)

  • Approximate geolocation data (city/region) derived from the IP address

  • Cookie identifiers and similar technologies (see Cookie Policy)

  • Ad interaction data (via Google Ads and Meta Pixel)

3. Purposes and Legal Bases for Processing

We process your personal data solely for the purposes described below and always on the basis of a valid legal ground in accordance with the revFADP:


1. Purpose: Handling enquiries and contact requests

  • Tools used: Web form, Mailchimp

2. Purpose: Processing orders and transport services

  • Legal basis: Performance of contract

  • Tools used: Stripe, PayPal

3. Purpose: Sending newsletters and commercial information

  • Legal basis: Data subject's consent

  • Tools used: Mailchimp

4. Purpose: Customer service

  • Legal basis: Performance of contract / Legitimate interest

  • Tools used: Email, phone

5. Purpose: Website usage analysis (statistics)

  • Legal basis: Legitimate interest (with right to object)

  • Tools used: Google Analytics

6. Purpose: Marketing and remarketing (targeted advertising)

  • Legal basis: Consent or legitimate interest depending on profile type

  • Tools used: Meta Pixel, Google Ads

7. Purpose: Maps functionality and geolocation integration

  • Legal basis: Legitimate interest / Consent (if GPS activated)

  • Tools used: Google Maps

4. Recipients and International Data Transfers

DAMO GmbH shares your data only with service providers necessary for the operation of the website and the provision of our services. All providers have been selected ensuring an adequate level of data protection:

 

  • Google LLC (Google Analytics, Google Ads, Google Maps) — USA. Transfer covered by Standard Contractual Clauses (SCC) approved by the European Commission and recognised by Switzerland.

  • Meta Platforms, Inc. (Meta Pixel / Facebook Ads) — USA. Transfer covered by SCC.

  • The Rocket Science Group LLC (Mailchimp) — USA. Transfer covered by SCC.

  • Stripe, Inc. (payment processing) — USA. PCI DSS certified. Transfer covered by SCC.

  • PayPal Holdings, Inc. (payment processing) — USA/Luxembourg. Transfer covered by SCC.

 

DAMO GmbH does not sell or rent your personal data to third parties for its own commercial purposes.

5. Retention Periods

  • Contact data and enquiries: maximum 3 years from the last interaction or until the right to erasure is exercised.

  • Contractual and billing data: 10 years in accordance with Swiss statutory accounting obligations (Art. 958f CO).

  • Newsletter data: for as long as the subscription remains active.

  • Analytical cookie data (Google Analytics): maximum 14 months according to the recommended standard configuration.

  • Access and security logs: minimum 12 months.

6. Your Rights as a Data Subject

In accordance with Articles 25 to 27 of the revFADP, you have the right to:

 

  • Access: to know what personal data we process about you.

  • Rectification: to request the correction of inaccurate or incomplete data.

  • Erasure: to request the deletion of your data where no legal retention obligation exists.

  • Objection: to object to processing based on legitimate interest, in particular for direct marketing purposes.

  • Restriction: to request the restriction of processing under certain circumstances.

  • Data portability: to receive your data in a structured, commonly used and machine-readable format.

  • Withdrawal of consent: to withdraw consent given at any time, without affecting the lawfulness of processing carried out prior to withdrawal.

If you are dissatisfied with our response, you have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC): www.edoeb.admin.ch.

7. Data Security

DAMO GmbH implements appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, alteration or disclosure. These measures include SSL/TLS encryption during data transmission, access controls, and confidentiality agreements with data processors.

 

In the event of a security breach that may result in a high risk to the rights of data subjects, DAMO GmbH will notify the FDPIC and, where applicable, the affected individuals, as quickly as possible.

8. Minors

Our services are not directed at persons under the age of 16. DAMO GmbH does not knowingly collect personal data from minors. If we become aware that we have collected data from a minor without the consent of their legal guardians, we will delete it immediately.

9. Changes to the Privacy Policy

DAMO GmbH reserves the right to update this Privacy Policy when necessary, for example due to legislative changes or modifications to the services provided. The updated version will be published on the website with the date of revision indicated. We recommend that you check this page periodically.
